The brand AutoInpsektor and website i.e. www.autoinspektor.in are owned and operated by SNB Auto Tech Services Limited (collectively referred as “AutoInspektor” Or “we”, “us” or “our”), having its office at WeWork Eldeco Centre, Malviya Nagar, New Delhi-110017. We are engaged in the business of inspecting vehicles for clients for the purpose of purchase of vehicle and provide services incidental and ancillary thereto. These services are provided online & offline.
Any information gathered through this Terms and Conditions shall be subject to our privacy policy and/or other policies, which is incorporated herein by reference and available at www.autoinspektor.in.
THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND AUTOINSPEKTOR; PLEASE READ IT CAREFULLY.
IF YOU DO NOT AGREE TO BE BOUND OR CANNOT COMPLY WITH ANY OF THE TERMS AND CONDITIONS AND/OR THE PRIVACY POLICY AND/OR ANY OTHER POLICY, PLEASE DO NOT CONTINUE WITH THE PAYMENTS TOWARDS AUTOINSPEKTOR. YOUR ACT OF MAKING THE PAYMENTS SHALL BE DEEMED AS YOUR UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF ALL THE TERMS AND CONDITIONS, THE PRIVACY POLICY AND OTHER POLICIES OF AUTOINSPEKTOR.
This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
AutoInspektor may change/alter the Terms & Conditions from time to time. Your continued use of AutoInspektor services constitutes your agreement to be bound by these Terms & Conditions as modified, from time to time except that modifications do not apply to any dispute arising prior to their effective date.
USING THE WEBSITE
The website enables you to book a used/new vehicle pre-purchase inspection (“Vehicle Inspection”). The vehicle inspection will be carried out by our inhouse inspector who is vetted by Autoinspektor (“Inspector”). Booking can also be done offline as well by visiting our office and/or telephonically. In all such cases the privacy policy and the instant Terms & Conditions shall remain applicable.
AutoInspektor is responsible for taking bookings, facilitating the arrangement of vehicle inspection and processing payments.
The website enables you to book a used/new vehicle pre-purchase inspection (“Vehicle Inspection”). The vehicle inspection will be carried out by our inhouse inspector who is vetted by Autoinspektor (“Inspector”). Booking can also be done offline as well by visiting our office and/or telephonically. In all such cases the privacy policy and the instant Terms & Conditions shall remain applicable.
AutoInspektor is responsible for taking bookings, facilitating the arrangement of vehicle inspection and processing payments.
When you use the website to make a booking for a vehicle inspection it creates two legal contracts:
One contract between you and us, under which we provide to you the means of booking, arranging and paying for a vehicle inspection; and
A further contract between you and the vehicle owner (term defined below) in respect of providing consent to us for vehicle inspection at the price quoted to you at the time of your booking.
Both of these contracts are made subject to following terms and conditions.
ONLINE / OFFLINE BOOKING
By making a booking, you agree to ensure that:
1. The information that you have supplied with regard to the online booking are complete and accurate;
2. The owner of the vehicle (“Vehicle Owner“) will consent to the inspection of the vehicle which may include but is not limited to allowing a full mechanical check, plug-in diagnostic check of the vehicle and a test drive, and has agreed the standard AutoInspektor liability waiver which is a part of this agreement;
3. The vehicle will be at or near to the address specified in the online booking at the agreed time;
4. AutoIspektor will be given access to the vehicle to carry out the vehicle inspection. The estimated completion timeline for vehicle inspections is 60 to 90 minutes. These completion timelines are estimates only and some vehicle inspections may be longer or shorter than the estimated completion times.
5. The bank transfer & UPI facility remains valid for booking;
6. You will ensure that Vehicle Owner makes all the information available that may affect the ability of inspector to carry out the vehicle inspection in a timely manner;
7. You will respond to any communications from inspector in a timely manner.

8. We will assign a reference number to your online/offline booking. Please quote this reference number whenever you contact us about your online/offline booking.
VEHICLE INSPECTION
1. Post raising of request online/offline, our dedicated experience manager will schedule the inspection as per your preferred date(s) and time(s) for the vehicle inspection.
2. If the vehicle inspection is delayed in an event due emergent situation or in respect of situation outside of inspector’s control, then we will contact you as soon as possible to let you know. For the avoidance of doubt, AutoInspektor shall not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract. You will not be charged in respect of any vehicle inspections which have not been carried out due to the unforeseen circumstances mentioned above and in case any advance payment has been receive the same shall be refunded to you within 7-10 days of raising of request for refund without any interest.
3. During the online/offline booking process, you must confirm that you have obtained consent from the vehicle owner, he has agreed to disclaimer for vehicle inspection and consent to carry out the Vehicle Inspection at the time(s) and date(s) provided in your booking.
4. If the vehicle owner, or such person authorized by the vehicle owner to deal with the vehicle, does not allow the inspector to carry out the vehicle inspection, or refuses to agree standard inspection disclaimer document, then you will be liable to pay the full cost of the vehicle inspection. It is your responsibility to ensure that the vehicle owner provides the consents at the time(s) and date(s) provided at the time of your online booking.
INSPECTION REPORT
1. On completion of the vehicle inspection, AutoInspektor will send to you the inspection report (the “Inspection Report”) on your registered email within 24-36 hours.
2. The inspection report shall include booking details, vehicle details, executive summary highlighting components in the following categories (a) Satisfactory as per vehicle age & mileage, (b) Attention – component(s) needs to be repaired/replaced (c) No access was provided at the time of inspection, and (d) Not applicable. The report will also include inspector’s observations categorized under essential & desirable items.
3. Inspection report will include a minimum of 30-second audio/video files or one combined audio/video file, which may include the vehicle’s external area, engine bay, boot area and/or interior.
YOUR RIGHT TO RESCHEDULE OR CANCEL A BOOKING
1. We will notify you of any hindrance or development in respect of the inspection of vehicle on account of any third party or the Vehicle owner, for example, the fact that a Vehicle Owner has refuses the vehicle inspection or non-availability of inspector at the revised requested time & location or because of a change in the law or relevant regulations, or any other reason. In such scenario and subject to our abovementioned terms and conditions, we may agree to reschedule or accept a new booking from you.

Do not provide us with information within reasonable time to carry out a vehicle inspection, for example, contact details of the vehicle owner;
The Vehicle Owner does not, at the scheduled inspection time allow the inspector to carry out the relevant vehicle inspection or in case of breach of these terms and conditions.
ISSUE WITH VEHICLE INSPECTION
1. We encourage users to communicate with their experience manager or/ inspector in case there is problem with the vehicle inspection.
2. In case the issue has not been satisfactorily resolved by the experience manager or / inspector, please reach out to us at wecare@autoinspektor.in and we will advise you on your next steps.
3. In the unlikely event that defects are discovered after purchase which were not identified in the report, please reach out to us at wecare@autoinspektor.in before instructing any repairs. If considered appropriate, a re-inspection of the area of concern may be provided. You may please note that buying of vehicle post inspection and/or receiving of the inspection report is purely and solely on your discretion and AutoInspektor cannot be held accountable for any defect or flaw not identified at the time of inspection. You are advised and encouraged not to solely rely upon our report before making a decision to purchase.
4. Guidance Note on Report and Disclaimer are part of the Terms and Conditions and are to be read as part of the Terms and Conditions.
PRICE & PAYMENT
The cost of a vehicle inspection is as indicated on our website. We take all reasonable care to ensure that the price of the vehicle inspection advised to you is correct. However, special inspection requests will have different price fees provided based on the location of inspection, nature of vehicle etc. For instance, rural areas where the coverage is not extended surcharge will be applicable, and will be shared by your experience manager before making the booking. For special inspection requests individual approach will be taken and fee will be provided accordingly. The price you pay will depend on inspection type and location of the vehicle at the time of booking the inspection.

OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
If you have a problem with a vehicle inspection, please reach out to your experience manager or/ inspector. In case the issue has not been satisfactorily resolved by the experience manager or/ inspector, please reach out to us at wecare@autoinspektor.in and we will advise you on your next steps.
We are not liable for any loss. You acknowledge that we are not responsible under any obligation to provide you with a refund or credit note in the event you are dissatisfied with a vehicle inspection and we will have no liability to you for any loss or damage to property, loss of profit, loss of business, business interruption, or loss of business opportunity suffered by you.
A lack of defect in any part of the Vehicle at the time of the inspection does not constitute a warranty or guarantee of the durability in any part of the Vehicle, nor is it a guarantee against defects arising in the future. Neither AutoInspektor nor the Inspector accepts liability for defects not reasonably apparent in any vehicles.
You accept that a diagnostic check of the systems with a scanner may not reveal fault codes previously cleared prior to the vehicle inspection and these may not be recorded in the inspection report.
The inspector will use well known generic diagnostic scanners, but you accept that sometimes the Inspector may be unable to access all the ECU subsystems due to a lack of availability of information released from manufacturer for a specific make and model on the diagnostic scanner software or the vehicle may be too new and software may not be yet released to that specific scanner manufacturer.
You further accept that on rare occasions the inspector may be unable to carry out a plug-in diagnostic scan because of an electrical fault.
You accept that in wet weather conditions or the vehicle is too dirty some minor scratches, dents would be impossible to notice.
You accept that vehicle inspector is unable to identify or determine while carrying out inspection on insurance written off vehicles.

REPRESENTATION, WARRANTIES & DISCLAIMERS
• By You: You represent and warrant to us that: (a) you are eligible to book and use the service and have the right, power, and ability to enter into and perform as required herein; (b) you will fulfill all of your legal obligations to each user and will make all reasonable efforts to resolve any user dispute or complaint to the user’s satisfaction; (c) all financial transactions will comply with all laws, rules, and regulations applicable to the you, including any applicable tax laws and regulations; and, (d) you will not use the Service, directly or indirectly, for any fraudulent undertaking or in any manner so as to interfere with the use of the service.

LIMITATION ON LIABILITY
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR EMPLOYEES, DIRECTORS, AGENTS AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS, THE SITE, AUTOINSPEKTOR MATERIALS, THE SERVICE (INCLUDING THE INABILITY TO USE THE SERVICE), ANY APPLICATION USING OUR SERVICE, OR ANY SERVICES OR GOODS PURCHASED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. INDEMNITY
You will indemnify and hold harmless us and our respective employees, directors, agents and representatives from and against any and all claims, costs, losses, damages, judgments, Tax assessments, penalties, interest, and expenses (including without limitation reasonable attorneys’ fees) arising out of any claim, action, audit, investigation, inquiry, or other proceeding instituted by a person or entity that arises out of or relates to: (a) any actual or alleged breach of your representations, warranties, or obligations set forth herein, including without limitation any violation of our Policies; (b) your wrongful or improper use of the Service; (c) any transaction submitted by you through the Service (including without limitation the accuracy of information that you provide or any claim or dispute arising out of products or services offered or sold by you); and (d) any transactions that you submit to our Service.
Governing Law: These Terms and Conditions of Use shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of New Delhi.

ASSIGNMENT

Subject to the foregoing hereinabove, these terms and conditions and the terms of the agreements executed with AutoInspektor will be binding on each party’s successors and permitted assigns. Any assignment or transfer in violation of this section will be deemed null and void.
You shall not assign or transfer any rights, obligations, or privileges that you have under these terms and conditions or under any agreement executed with AutoInspektor without our prior written consent. Subject to the foregoing hereinabove, these terms and conditions and the terms of the agreements executed with AutoInspektor will be binding on each party’s successors and permitted assigns. We will not be considered to have waived any of our rights or remedies, or portion of them, unless the waiver is in writing and signed by us. Our failure to enforce the strict performance of any provision of any agreement executed with us (including any Policy) will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of such agreements (including any Policy).

SEVERABILITY

If such construction is not possible, the provision will be severed from these terms and conditions and the rest of the terms and conditions shall remain in full force and effect.

ENTIRE AGREEMENT
These Terms and Conditions, including without limitation the Policies and the general terms and conditions of the Site, constitute the entire agreement/terms and conditions of the parties with respect to the subject matter and supersede and cancel all prior and contemporaneous agreements, claims, representations, and understandings of the parties in connection with the subject matter herein. Except as expressly provided above, no modification or amendment of these terms and conditions will be binding on AutoInspektor unless set forth by us.

8. We will assign a reference number to your online/offline booking. Please quote this reference number whenever you contact us about your online/offline booking.
VEHICLE INSPECTION
1. Post raising of request online/offline, our dedicated experience manager will schedule the inspection as per your preferred date(s) and time(s) for the vehicle inspection.
2. If the vehicle inspection is delayed in an event due emergent situation or in respect of situation outside of inspector’s control, then we will contact you as soon as possible to let you know. For the avoidance of doubt, AutoInspektor shall not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract. You will not be charged in respect of any vehicle inspections which have not been carried out due to the unforeseen circumstances mentioned above and in case any advance payment has been receive the same shall be refunded to you within 7-10 days of raising of request for refund without any interest.
3. During the online/offline booking process, you must confirm that you have obtained consent from the vehicle owner, he has agreed to disclaimer for vehicle inspection and consent to carry out the Vehicle Inspection at the time(s) and date(s) provided in your booking.
4. If the vehicle owner, or such person authorized by the vehicle owner to deal with the vehicle, does not allow the inspector to carry out the vehicle inspection, or refuses to agree standard inspection disclaimer document, then you will be liable to pay the full cost of the vehicle inspection. It is your responsibility to ensure that the vehicle owner provides the consents at the time(s) and date(s) provided at the time of your online booking.
INSPECTION REPORT
1. On completion of the vehicle inspection, AutoInspektor will send to you the inspection report (the “Inspection Report”) on your registered email within 24-36 hours.
2. The inspection report shall include booking details, vehicle details, executive summary highlighting components in the following categories (a) Satisfactory as per vehicle age & mileage, (b) Attention – component(s) needs to be repaired/replaced (c) No access was provided at the time of inspection, and (d) Not applicable. The report will also include inspector’s observations categorized under essential & desirable items.
3. Inspection report will include a minimum of 30-second audio/video files or one combined audio/video file, which may include the vehicle’s external area, engine bay, boot area and/or interior.
YOUR RIGHT TO RESCHEDULE OR CANCEL A BOOKING
1. We will notify you of any hindrance or development in respect of the inspection of vehicle on account of any third party or the Vehicle owner, for example, the fact that a Vehicle Owner has refuses the vehicle inspection or non-availability of inspector at the revised requested time & location or because of a change in the law or relevant regulations, or any other reason. In such scenario and subject to our abovementioned terms and conditions, we may agree to reschedule or accept a new booking from you.

ISSUE WITH VEHICLE INSPECTION
1. We encourage users to communicate with their experience manager or/ inspector in case there is problem with the vehicle inspection.
2. In case the issue has not been satisfactorily resolved by the experience manager or / inspector, please reach out to us at wecare@autoinspektor.in and we will advise you on your next steps.
3. In the unlikely event that defects are discovered after purchase which were not identified in the report, please reach out to us at wecare@autoinspektor.in before instructing any repairs. If considered appropriate, a re-inspection of the area of concern may be provided. You may please note that buying of vehicle post inspection and/or receiving of the inspection report is purely and solely on your discretion and AutoInspektor cannot be held accountable for any defect or flaw not identified at the time of inspection. You are advised and encouraged not to solely rely upon our report before making a decision to purchase.

A lack of defect in any part of the Vehicle at the time of the inspection does not constitute a warranty or guarantee of the durability in any part of the Vehicle, nor is it a guarantee against defects arising in the future. Neither AutoInspektor nor the Inspector accepts liability for defects not reasonably apparent in any vehicles.
You accept that a diagnostic check of the systems with a scanner may not reveal fault codes previously cleared prior to the vehicle inspection and these may not be recorded in the inspection report.
The inspector will use well known generic diagnostic scanners, but you accept that sometimes the Inspector may be unable to access all the ECU subsystems due to a lack of availability of information released from manufacturer for a specific make and model on the diagnostic scanner software or the vehicle may be too new and software may not be yet released to that specific scanner manufacturer.
You further accept that on rare occasions the inspector may be unable to carry out a plug-in diagnostic scan because of an electrical fault.
You accept that in wet weather conditions or the vehicle is too dirty some minor scratches, dents would be impossible to notice.
You accept that vehicle inspector is unable to identify or determine while carrying out inspection on insurance written off vehicles.
